In some instances permission will be granted but it must be in writing and authorized by Paul Williamson. 4) You agree and acknowledge that you are fully aware of the inherent dangers of working with equines of any breed, skill level or activity. 5) You freely and voluntarily agree to hold harmless Paul Williamson, Hybrid Horsemanship™, its agents, heirs, employees and assignees; their officers, directors, shareholders, employees and anyone else directly or indirectly connected with the Hybrid Horsemanship (herein referred to as “The Parties”) for negligence, liability and/or responsibility relating to you or any other party, resulting from the use of these methods. 6) You agree that you have read and understand a) That any use of these methods, particularly any unauthorized or unintended use, is expressly prohibited. b) You agree that you have read and understand, and have freely and voluntarily entered into the following Release and Hold Harmless Agreement with The Parties and that you will be bound under the terms, conditions and jurisdiction of the State of Georgia and Georgia State Equine Liability Law. Chapter 12 of Title 4 of the Official Code of Georgia Annotated. c) Negligence: You agree that by accepting these terms all parties have a mutual understanding of what constitutes the term “negligence.” Negligence is any act that can foreseeably cause harm; activities for which you are unsuited, unskilled or unprepared; acts that are inherently dangerous and/or that you have tried without proper supervision and/or the explicit authorization to attempt. Act that you have explicitly been warned not to try we both agree would constitute negligence on the part of the viewer. d) Negligence is also defined as “The failure to use reasonable care. The doing of something which a reasonably prudent person would not do, or the failure to do something which a reasonably prudent person would do under like circumstances. A departure from what an ordinary reasonable member of the community would do in the same community. Negligence is a 'legal cause' of damage if it directly and in natural and continuous sequence produces or contributes substantially to producing such damage, so it can reasonably be said that if not for the negligence, the loss, injury or damage would not have occurred.” Black's Law Dictionary (7th ed. 1999). Liability can also be defined as “any legal responsibility, duty or obligation.” Ibid. Equine Activity Release and Hold Harmless Agreement By accepting entry into this website and/ or the licensing and/or purchasing of any CD, DVD, Video and/or Product related to “Hybrid Horsemanship” you agree: 1) That you have read and understand, and now freely and voluntarily enter into this Release and Hold Harmless Agreement with The Parties (herein referred to as “The Parties”), understanding that this Release and Hold Harmless agreement is a waiver of any and all liability(ies). You further agree that all warnings in this Agreement have been, and are, clear and unambiguous; that this waiver is clear and explicit and contains clear, explicit and unambiguous language pertaining to your waiving these rights. (If you do not agree, understand or commit to these terms, in full, Decline this Agreement and log off now. Definitions 1) "Equine" means a horse, pony, mule, donkey, or hinny. 2) "Equine activity" means but is not limited to: a. Equine shows, fairs, competitions, performances, or parades that involve any or all breeds of equines and any of the equine disciplines, including, but not limited to, dressage, hunter and jumper horse shows, grand prix jumping, three-day events, combined training, rodeos, driving, pulling, cutting, polo, steeplechasing, English and western performance riding, endurance trail riding and western games, and hunting; b. Equine training or teaching activities, or both; c. Rides, trips, hunts, or other equine activities of any type however informal or impromptu d. Any other ctivities as described in Chapter 12 of Title 4 of the Official Code of Georgia Annotated. Terms of Use Under no circumstances should these videos, DVDs, ideas and/or methods be used except under the official tutelage, guidance and/or protection of Paul Williamson in attendance. Any other use must be expressly authorized, in writing, by Paul Williamson.
